Land law problem question Essay Example | Topics and Well Written Essays - 2750 words
Land law problem question - Essay Example The three of you were pursuing an accountancy course at the time and hoped to establish the accountancy firm as soon as you completed the course and in the event employ other relatives. However, since Ben and Clare realized they could not raise enough money to complete their course after the purchase they acquired a mortgage of ?250,000 from Macau Bank against the property. You, Amy, signed a waiver form of the bank to enable the loan application to go through, though you may not have sought legal advice before doing so. Ben subsequently died in 2010 and Clare re-mortgaged the house for ?50,000 to Taiwan Bank in order to take additional training in order to cover for the loss of Benââ¬â¢s expertise. This she did acting as the sole owner of the property without you being consulted. Now in 2011 Clare has decided that she is no longer interested in the accountancy firm and has fallen behind on mortgage repayments. You, Amy, on the other hand is still interested in pursuing the origin al objective of starting the family accountancy firm. Your Current Situation Your first challenge as Amy is to prove ownership of the property even though you were not registered as the owner having entrusted the registration to your older cousins Ben and Clare. ... to register a registrable disposition of a registered estate must provide to the registrar such information as the rules may provide about any unregistered interest affecting the estate whichââ¬â (i) falls within any of the paragraphs of Schedule 3, and (ii) is of description specified by the rules (Land Registration Act, 2002, 6 (71) (a-b). What all this means is that in your case, you do have an interest in the property that was registered and that was supposed to be stated out-rightly at the time that your two cousins were getting registered in trust to own the property that your interests are included. Whether this was done or not should be confirmed by you. However, given the events that subsequently took place, it is quite clear that your interests were catered for during this registration. A look at the mentioned Schedule 1 and Schedule 3 shows that the interest of a person in actual occupation of the property is catered for (Land Registration Act, 2002, Schedule 1(2). Sin ce you have an interest in the house and the land on which it sits, and you actually occupy it, this provision covers persons such as yourself. Considering the evidence that your interests were included I glean as follows. First of all, you were asked to sign the waiver form when your two cousins were applying for the mortgage from Macau bank. Signing the waiver basically means that in case of failure to repay the mortgage, then the entire house, including your share of it, could be attached to recover the outstanding dues (Degeling & Edelman, 2008, 31). The second indicator was that when Clare sought a second mortgage from Taiwan Bank you should have been consulted save for the pain you were in. This means that your interest was taken into consideration even at this point. That being the case

Evaluate Unilever's financial strategy - Essay Example Then the sources of Finance is analysed using Modigliani-Miller Theorem and it reveals that the debt to equity position of the organization is good and has significant impact on its market value. However, the cash position of the company is not stable and requires attention from the management. The Dividend policy of the organization is healthy and looks at wealth maximization of the shareholders. The managers are concerned about the dividend return and regularly review the dividend policies. Moreover, the economic condition is quite unstable and a sluggish growth is expected. In this regards it is recommended that the organization should give attention towards their cash position and should enhance other activities through which their profitability can be enhanced. The organization is also suggested to maintain healthy debt equity ratio, having higher debt may negatively impact their firm value. Introduction The Unilever Group started their operations in 1885 but was not established until 1930 when the business actually joined forces to create the well established business prior to the start of 20th century. The corporate vision of the organization aims towards helping the people in order to look and feel good and get more out of their life. The first priority for the organization is their consumers and then comes the employees, communities and the suppliers. The organization aims to fulfil their responsibilities by serving their customers and make their shareholders eventually rewarded. Financial strategy is a portfolio that includes corporate strategic plans that involves financing decision and optimum investment that helps in attaining the specified objectives. It is an area of managerial policies that determines the financial and investment decisio ns, which in turn leads to the wealth maximization of the shareholders (Hill, 2009). This paper focuses on the financial strategy of the organization and provides recommendation on the basis of that. Corporate Life Cycle The Corporate life cycle can be segregated into four stages through which an organization passes. The four stages are introduction, growth, matured and decline. The introduction stage is the point where the organization first places its product and services in the market for the customers. In this stage it starts capturing the market share. The next stage is the growth stage in which the organization with the best quality product or service is at the top of the competition. The sales increases and the organization spend money in building the brand. The demands of the consumers are at the highest point. The third stage is maturity where the organization has maximised their profit and is operating at a stable place in the market. Here the organization decides whether to withdraw their product or services from the market or to bring some innovation in them such that they remain in the market. The main focus is on the sustainability of the business. The last stage is the decline stage. At this stage the organization has already introduced their new products or next generation product. The

Computation finance - Essay Example Creation of these dark pools has been possible because of existence of electronic trading and the fragmentation of avenues of conducting financial trading. The participants access them directly amongst themselves or through crossing networks. Dark pools are made up of three types, including where the independent entities create a distinctive and differentiated means of trading, those that are owned by brokers allowing the clients of the broker to trade amongst themselves in anonymity, and those created by the public exchanges themselves, meant to give their customers a chance to enjoy trading in anonymity and hiding of orders while trading. Hidden liquidity allows traders to ââ¬Ëhideââ¬â¢ all or a part of their orders, which results into a market with two components ââ¬â a displayed component and a non-displayed component. Hiding of orders, however, makes market participants to access incomplete knowledge regarding the marketââ¬â¢s general depth. This paper is going to look at how these dark pools of liquidity work, why they are needed and their impact on the visible market. Most of the electronic exchanges that are order-driven use specific order types to provide liquidity such as what is referred to as ââ¬ËIceberg Orderââ¬â¢. An Iceberg Order is a passive order that is split into small portions, with partly or none of which is visible to the public. By concealing the actual quantity of the order, it is possible to tame price movements and reduce leakage of information, as well as any other flows that culminate from significant adjustments in the supply of stocks ââ¬â this is called market impact. Splitting of orders is automated through order management systems, and it is a standard strategy used by many institutional investors.1 2 Companies are allowed to choose from three types of dark pools. The first include those owned by broker

Americas Global War on Terrorism Essay Example for Free
Americas Global War on Terrorism Essay At 8:46 am, on September 11, 2001, the world would take witness to an event that would change it forever. Five hijackers, with the support of a terrorist group named Al Qaeda, crashed a passenger jet into World Trade Center Tower 1, and seventeen minutes later a second passenger jet was crashed into World Trade Center Tower 2. Now, everyone can remember exactly where they were when they received the news of the attack, but, what most Americanââ¬â¢s didnââ¬â¢t realize is that these events would lead to the majority of the world into war. This was the first time that the United States would participate in a war against and idea, terrorism, and not a declaration of war against a country itself. In every war that the United States had been involved in, they had been faced against an enemy in the form of a country. Whether it was Spain, Mexico, Britain, France, Germany, Japan, or even against itself, the United States always had a target. These ââ¬Å"targetsâ⬠usually had a uniform; they were also in support of a dictator, king, or even a tyrant. But with the War on Terror, the United States and its allied NATO Nations were not taking actions against a country; they were taking actions against an ideology that had affected the entire planet. The route of this ideology can be traced back to one man, Osama bin Laden. Osama bin Laden, with the help of the United States, forced an invading Soviet Russia out of the country of Afghanistan in the 1980ââ¬â¢s. Then, with the support of a radical Islamic state, and the formation of a radical group calling themself al-Qaeda, he declared war on the United States in 1996 (Lansford, Watson Covarrubias, 2009). Bin Laden was quoted saying, ââ¬Å"If the instigation for jihad against the Jews and the Americansâ⬠¦is considered a crime, then let history be a witness that I am a criminal (Lansford, Watson Covarrubias, 2009).â⬠With this foundation of hatred towards Western influence in the modern world, Osama bin Laden and his radical group al-Qaeda instigated a War against the world. The group al-Qaeda has taken responsibility of many terrorist attacks against the United States and its allied countries. From the World Trade Center attacks of 2001, to the Spain subway bombings of 2004, al-Qaeda has been at the center of these terrorist attacks. Unfortunately, unlike most wars declared against a country, al-Qaeda has roots in many countries. Theyââ¬â¢ve been linked to attacks in: Africa, Europe, North America; are believed to have ties to other terrorist cells like the Taliban, and the Revolutionary Armed Forced of Colombia; and are known to have cells based in Afghanistan, Iran, and Pakistan (Lansford, Watson Covarrubias, 2009). Former President George Bush described al-Qaeda as ââ¬Å"a fringe form of Islamic extremism that has been rejected by Muslim scholars and the vast majority of Muslim clerics; a fringe movement that perverts the peaceful teachings of Islam (Holloway, 2008).â⬠This declared War on Terror was against terrorist groups, like al-Qaeda, but many did believe that the Former President had a hidden agenda. With the attacks of September 11th, a new foreign policy known as, ââ¬Å"Bush Doctrine,â⬠was implemented by the Bush administration. The ââ¬Å"Bush Doctrine,â⬠which the Bush administration rarely ever called its new foreign policy was based around four ideas: to make no distinction between terrorist and the countries harboring them, take the fight to enemies overseas before they can attack the United States, confront threats before they become threats, and promote democracy instead of terrorist ideology (Holloway, 2008). At the beginning of the war, the American people being full of patriotism and wanting revenge for the 9/11 attacks were in 100% agreement with this policy, but as time passed and the years that this ââ¬Å"warâ⬠has gone on, more and more are in less support and just want the United States military to be brought home. Towards the end of President Bushââ¬â¢s second term, he began to be under constant attack due to the war in Iraq and Afghanistan. He was accused of invading Iraq under false pretenses of: weapons of mass destruction, and a direct influence of 9/11 by Saddam Husseinââ¬â¢s regime (Holloway, 2008), a plateau that our current President, Barack Obama, used to his advantage during his initial campaign. Yet, even though Former President Bush was attacked and scrutinized about his policies, he stood by his initial belief that his ââ¬Å"Global War on Terrorâ⬠was against an ideology, and not a certain country. Whether or not the current 10-year war was actually waged against Osama Bin Laden, Saddam Hussein, Muammar al-Gaddafi, or any other tyrant is truly unknown, and if the September 9/11 attacks were hoaxed and just a coercion for the American people to be tricked into war, who knows. What can be known is this; the War on Terror is the first time that the United States has declared war on an idea, a way of life, and not against a country of its own, and because of this, the true length of this war has the ability to last forever. Holloway, D. (2008). 9/11 and the war on terror [electronic resource] / david holloway . Edinburg University Press. Lansford, T., Watson, R., Covarrubias, J. Impressions of what life was like for the colonists Essay Example for Free
Impressions of what life was like for the colonists Essay Life in the new world for the colonists was like nothing that individuals in todayââ¬â¢s society can understand. After taking the Would You Have Survived the Colony quiz on the website, it is easy to see that surviving the colonial atmosphere might have been one of the most difficult tasks on earth. This is because of the differences in culture, in food, in work load, and with other important aspects of life that would take an awful lot of adjusting. When the Europeans came across the pond to colonize America, they had a lot of adjusting to do, as well. The first way that they had to adjust to the new world was with the environmental changes. Life in America was rough because of all of the elements. Europe was a flat area with a lot of rain and average weather. When they came to America, they had to put up with mountains, with rivers, and with lots of other elements. There was also the animals that they had to adjust to. Because the United States was just being colonized and modernized, lots of wild animals were running around where people were living. Among them were predators like bears and big cats. When people went out to find food or to cut wood, they had to put up with this nuisance. This was how life was so difficult and it was something that people of todayââ¬â¢s culture would struggle with. When taking that quiz, I thought about the clothes that people would wear if they had to go back to that time. I like to be in nice clothes. Though I do not have to have the latest in fashion, I do like to keep up with the times. Back then, the clothes had to last a long time and they had to be able to stand up to the elements. People had to track through the woods, so the clothes had to be able to put up with that challenge. Since there was no air conditioning or heating at the time, the clothes also had to be much more of an insulator in the difficult times. This would be a difficult adjustment for someone like myself if I were to go back in time. The last and most important thing is the overall work ethic and lifestyle that would have to be employed. Every time those people wanted something, they had to work hard for it. If they wanted a fire, they had to cut down some wood and start the fire. If they wanted to eat something, they had to go kill it and cook it. There were no fast food restaurants to go grab food at. Today, people go to work in order to make money to buy nice things. Those people had to go to work in order to keep themselves and their families alive. That was in addition to actually protecting themselves from the elements and the things in the environment that were so difficult. Overall, life in the colonial period was difficult and it would definitely be an adjustment for anyone who had to go back in time and face it. The differences in the economy and with the environment are so profound that people had to go through a whole lot each and every day. The main difference is that there were no days off if you felt bad or simply needed some rest.

Each school setting will have a anti-bullying and behaviour policy in place outlining what constitutes bullying and the standard of behaviour that is expected in the school. Anti bullying policy The anti bullying policy will set out a definition of what constitutes bullying and the different types of bullying that can be experienced. I will include the following. Unacceptable behaviour and definitions of this The responsibilities that the school holds for ensuring that action is taken if allegations are made or bullying is suspected Responsibilities of staff and governors Pupils have the right to learn free from intimidation and fear The needs of the victim are paramount Schoolââ¬â¢s will not tolerate bullying behaviour Bullied pupils will be listened to Reported incidents would be taken seriously and thoroughly investigated Behaviour policy The behaviour policy will usually set out the rule and responsibilities of children and teachers within the school setting and the types of behaviour that are not acceptable. It will show the consequences of non-compliance and the procedures that will be followed if unacceptable behaviour takes place. Policies and procedures should come into force to ensure that bullying is stopped, and to make sure it does not happen again. The victim should have a meeting with the teacher to put together strategies in case the situation occurs again Point out that the behaviour that has occurred is unacceptable, and provide information how they are going to be monitored Meeting with staff and other children who have witnessed the bullying should take place to obtain additional evidence Consider if external agencies should get involved Make use of curriculum to restore self esteem in the victim and to discuss bullying and unacceptable behaviour Behaviour policy for schools would include the following. To create a consistent environment that expects, encourages and recognises good behaviour and one in which everyone feels happy and safe To help pupils develop self respect, self control and accountability for their own behaviour To encourage the partnership between home and school Staff responsibilities To role model good behaviour and positive relationships To emphasise the importance of values and being valued To provide an effective learning and teaching environment To encourage positive relationships based on kindness, empathy and respect To ensure fair treatment for all regardless of ability, age, sex, or race Show appreciation of the efforts and contributions of everyone Children should learn to expect recognition for positive behaviour and fair and consistency applied consequences for inappropriate behaviour. Recognition and praise should be given where ever possible for both work and behaviour. These recognitions and praise could be the following. Stickers for good behaviour (warn by the child) Positive recognition to parents for good behaviour House points awarded Good behaviour notes sent home by parents Certificates (presented in assembly) All these policies and procedures are in place to ensure the schoolââ¬â¢s expectations and standards are met. All schoolââ¬â¢s have policies and procedures in place to support staff and children from situations such as bullying to provide a safe and secure environment for the children to learn and be happy in. children should have the right to learn in a safe, secure and anti-bullying environment and these policies help children from doing that. Behaviour policies also help in the school setting by encouraging children and staff to behave how they should and be treated how they would like to be treated I appositive way. Reference/bibliography www.stopbulkying.gov.uk (5.3) Supporting a child when bullying is suspected or alleged Within a school setting there are policies and procedures in place for the correct procedure to be followed if a child is being bullied or if bullying is suspected. As a support assistant it is very important that they are approachable so that children feel able to confide any instances of bullying. Some children who are being bullied would find it difficult and would be scared to share their feelings and to report the bullying. It is important to reassure the children that they have done the right thing in reporting the bullying, and that they will be 100% supported now that the bullying has been disclosed. Parents should be made aware of the school behaviour and anti-bullying policies to inform them of their childââ¬â¢s rights and the ways that the school can support them. When dealing with a child who is being bullied they can be upset but may not show their feelings. It is very important to take the problem seriously. The child has to be listened to and re-assured that they are doing the right thing by sharing their worries and feelings. For parents the signs to look out for if a child is being bullied are. Coming home with damaged or missing clothes, without money they should have, or with scratches or bruises they shouldnââ¬â¢t have Having trouble with homework for no apparent reason Using a different route between home and school Feeling irritable, easily upset or particularly emotional What can you do if you suspect a child is being bullied? Personal Narrative: I have seen Elvis Presley :: Celebrity Actor Acting Performing Musician
I Have Seen Elvis While driving down the expressway late last Saturday night I saw the strangest thing. There on the side of the road was an old broken-down blue Cadillac. As I passed, that's when I saw it. Out of the corner of my eye; it was him. There stood Elvis Presley, the King, kicking at the flattened tire of his rusted out Cadillac. I swear it was him. He had the side-burns, the wonderfully slicked back hair, and just as he went out of sight I swear he was doing that lip thing. As I think back on that night I wonder to myself if it was really him or if I just really wanted it to be. To me he is a symbol of both a lifestyle and a generation. Even though he supposedly died a month before I was born, his image and his likeness has so much meaning for me. Was it his greasy hair, the rebellious sexuality of his gyrating hips or just that sullen look in his eye? All these years I have never really known how my obsession with him came about. Now that I am in college I am beginning to question how thi s man of relatively little talent became such a hero to me and such a legend of American pop-culture? I guess for me, I am just infatuated with his image. You could say I'm sold on it. Elvis was everything I have always wanted to be. He was a rebellious loner and also incredibly popular. Elvis was always carrying around a pretty guitar but it is rumored he could barely play three cords on it. Presley was so phenomenally talented that even after dead for more than twenty-two years, he is still making more money than the average hard working American. He was a poor southern boy who was manufactured and constructed into American royalty. It is for these reasons that I hold a special place in my heart for Elvis. It is also for these reasons that I will from now on respectfully refer to him as, The King. The King is the result of the manipulation and the marketing of the American public through the use of the mass media. The first weapon used to target the wallets of the American people was the record. Rock 'n' Roll, a rebellious new sound that was immediately embraced by the young teen-agers of the fifties was a great turning point in our American society.
